Terms & Conditions of Sale

These terms apply to consumer purchases from Bathwise Limited through www.bathwise.uk.com unless a separate written agreement applies. If you are buying wholly or mainly for business purposes, separate trade terms may apply and consumer rights referred to below may not apply to you.

1. About Bathwise

Bathwise Limited is registered in England and Wales under company number 05967948. Our registered office and showroom is 265–271 Northfield Avenue, London, W5 4UA. Our email address is info@bathwise.uk.com.

2. Products and information

We take reasonable care to describe and present products accurately. Bathroom products can nevertheless have manufacturing tolerances, natural material variation and differences in colour or texture between batches. Screen settings and photography can also affect how a finish appears.

Dimensions, technical drawings and manufacturer information should be checked for the particular product and version ordered, especially before building work, drilling, cutting, tiling or installation. If a particular dimension, finish, compatibility requirement or use is essential to your project, tell us before ordering so that it can be considered as part of the contract.

3. Prices

Prices shown to consumers are in pounds sterling and, where applicable, are displayed inclusive of VAT. Delivery or other additional charges will be shown or communicated before you place the order.

If a clear pricing or description error is identified before we accept an order, we will contact you. We will not substitute a materially different product or impose a materially higher price without your agreement.

4. Placing an order and formation of the contract

When you place an online order, you are making an offer to buy the goods shown in your order. An automated acknowledgement confirms that we have received the order; it does not necessarily mean that we have accepted every item.

We may need to confirm stock, supplier availability, delivery arrangements, product configuration or payment before accepting the order. The contract is formed when we send confirmation that the relevant goods have been accepted for supply or dispatched, unless we expressly agree otherwise.

If we cannot accept an order, for example because an item is unavailable, we will tell you and refund any amount taken for the item without undue delay.

5. Payment

Available payment methods are shown at checkout or agreed with you for an offline order. Payments may be processed by third-party payment providers. You must use a payment method that you are authorised to use.

6. Availability and lead times

Some bathroom products are held in stock while others are sourced from manufacturers or distributors after an order is placed. Lead times can vary. We will give you the delivery information available to us and update you if a material delay becomes known.

Being ordered from a supplier or manufactured after order does not, by itself, mean that a consumer product is excluded from statutory cancellation rights. If an item is genuinely made to your specifications or clearly personalised and a legal cancellation exception applies, we will make that clear before you order.

7. Delivery and collection

Our Delivery & Collection Policy forms part of these terms. It explains delivery area, charges, access, large or fragile goods, split deliveries, checking deliveries and collection. If no different delivery period is agreed, we will meet the delivery obligations imposed by consumer law.

8. Your right to cancel and return eligible distance purchases

Consumers who buy eligible goods online or through another distance-selling method normally have a statutory 14-day cancellation period. Details, exceptions, return arrangements and refund timing are set out in our Returns, Cancellations & Refunds Policy, together with a model cancellation form.

9. Your rights if goods are faulty or do not conform

Nothing in these terms excludes or limits statutory rights relating to goods that are faulty, not of satisfactory quality, not fit for an applicable purpose, not as described or otherwise do not conform to the contract.

Depending on the circumstances, consumer law can provide remedies including a short-term right to reject, repair or replacement, price reduction or a final right to reject. Manufacturer guarantees are additional to, and do not replace, your rights against Bathwise as the retailer where Bathwise is the seller.

10. Product suitability and installation

Many bathroom products require professional assessment and installation. You are responsible for giving us accurate information that you know is relevant to the order, such as dimensions and site constraints. We are responsible for providing goods and any agreed services with the standard required by law.

If Bathwise has not agreed to measure, survey, design or install your project, you or your installer should verify site dimensions, services, compatibility, structural conditions and installation requirements before irreversible work begins.

This clause does not exclude responsibility where you reasonably relied on advice that formed part of our contract or where liability cannot lawfully be excluded.

11. Design and installation services

Design, project support and installation are supplied only to the extent stated in the relevant quotation, order confirmation or written scope. The documents for that project should identify what is included, assumptions, payment stages where applicable, programme information and responsibilities.

If a consumer enters into a service contract at a distance or off premises, statutory cancellation rights may apply. If you expressly ask for a service to begin during a cancellation period, the legal consequences and any proportionate payment that could become due must be explained and agreed as required by law.

12. Changes requested after ordering

If you ask to change a product, quantity, specification, finish, delivery arrangement or service after the contract is formed, we will tell you whether the change is possible and whether it affects price, lead time or other agreed terms. We will not make a material customer-requested change without confirming the revised position.

13. Events outside reasonable control

Occasionally performance may be delayed by events outside our reasonable control. If this happens, we will take reasonable steps to reduce the effect of the delay and keep you informed. Your statutory rights, including rights that may arise from serious delivery delay, are not removed by this clause.

14. Our responsibility to consumers

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that cannot be excluded under consumer law.

For consumer contracts, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable or for business losses arising from a consumer purchase.

15. Website content and intellectual property

The Bathwise website, branding, original text, layout and other content created for Bathwise are protected by applicable intellectual-property laws. Manufacturer names, trade marks, imagery and other third-party materials remain the property of their respective owners. You may use the website for normal personal shopping and project-research purposes but may not reproduce substantial website content for commercial use without permission.

16. Third-party websites

Our website may link to manufacturer or other third-party websites for additional information. We are not responsible for the content or privacy practices of third-party sites. A third-party link does not change who your seller is for a Bathwise order.

17. Complaints

If something has gone wrong, contact us at info@bathwise.uk.com or write to Bathwise Limited, 265–271 Northfield Avenue, London, W5 4UA. We will try to resolve the issue fairly and without unnecessary delay. This complaints process does not restrict your legal rights.

18. Governing law

These terms are governed by the law of England and Wales. If you are a consumer, you also retain any mandatory protections and court rights that applicable law gives you based on where you live.

19. General

If part of these terms is found to be unenforceable, the remaining terms continue to apply. A delay in enforcing a right does not necessarily waive it. No person other than you and Bathwise has a right to enforce these terms unless the law or a separate written agreement provides otherwise.
